Terms of Service

These Terms explain the rules for using Cara. We kept them in plain language. The most important point: Cara gives general health information, not medical advice. In an emergency, call 911.

1.Accepting these terms

These Terms of Service (“Terms”) are an agreement between you and Cara Technologies, Inc. (“Cara,” “we,” “us”). They apply when you use the Cara mobile app, the caramedical.com website, and related services (together, the “Service”). By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

Medical practices that use the Cara platform do so under a separate written agreement with Cara. If that agreement conflicts with these Terms, that agreement controls for the practice.

2.What the Service is

The Cara app is a chat-first health assistant with a personal health vault you control. You can tell Cara about your health, upload lab reports and documents, connect Apple Health and devices, set up reminders, connect practices you already see, and optionally connect your Google or Microsoft account.

The Cara platform is software that medical practices use for their patient portal, scheduling, forms, messaging, and EHR integrations.

We may add, change, or remove features over time. We will try to give notice of changes that significantly affect you.

3.Cara is not medical advice

In an emergency, call 911. If you are in a mental health crisis or thinking about suicide, call or text 988 (the Suicide and Crisis Lifeline). Do not use Cara for emergencies.

Cara provides general health information and tools to help you organize your care. Cara is not a doctor, does not practice medicine, and does not diagnose or treat any condition. Using Cara does not create a doctor and patient relationship between you and Cara.

Always talk with a qualified clinician before making decisions about your health, and do not ignore or delay professional medical advice because of something you read in Cara. No clinician reviews your chats with Cara unless you are using a service provided by a practice.

4.Practices and clinicians

Practices and clinicians you connect with through Cara are independent of Cara. They are solely responsible for the care they provide, including their medical advice, diagnoses, treatment, and records. Cara does not employ or supervise them and is not responsible for their services. Your relationship with a practice is governed by your arrangements with that practice.

5.Who can use Cara

You must be at least 18 years old to use the Cara app. By using it, you confirm that you are 18 or older and able to agree to these Terms.

6.Your account and security

You can sign in with an emailed code, with Apple, or with Google. Please give us accurate information and keep it up to date.

You are responsible for activity on your account and for keeping your device, email account, and sign in methods secure. Tell us right away at security@caramedical.com if you think someone has accessed your account without permission.

7.Caregiver access

You may manage another adult’s care in Cara only through a verified caregiver link that they (or someone legally authorized to act for them) approve. You must not use Cara to access anyone else’s information without proper authorization. A caregiver link can be removed at any time, and access ends when it is removed.

8.Connected accounts and practice links

When you connect a practice, Apple Health, a device, or a Google or Microsoft account, you authorize Cara to access and use information from that source on your behalf, as described in our Privacy Policy. Linking a practice requires a one time code to confirm it is you.

You can disconnect any of these at any time in the app. After you disconnect, Cara stops accessing that source. Your use of those services is also governed by their own terms.

9.AI features and their limits

Cara uses AI to answer questions, read documents, and summarize your information. AI can make mistakes. It may misread a document, miss information, or give an answer that is incomplete, out of date, or wrong.

  • Check important information, such as medicine doses and lab values, against the original source or with your clinician.
  • Do not rely on Cara as your only source of health information.
  • AI answers are general information, not medical advice.

10.Acceptable use

When you use Cara, you agree not to:

  • Break any law or violate anyone else’s rights
  • Access or try to access information about another person without their authorization
  • Pretend to be someone else or give false identity information
  • Interfere with, overload, or try to break the security of the Service
  • Copy, reverse engineer, or scrape the Service, except where the law allows
  • Upload malware or harmful content
  • Use the Service to build a competing product

11.Your health data and privacy

You own the information you put into Cara. You give Cara permission to store, process, and use it only to provide and protect the Service for you, as described in our Privacy Policy. We never sell your health information or use it for advertising.

You can download your data in the app (“Download my data”) and delete your account at any time.

12.Third party services

The Service works with services run by others, such as Apple, Google, Microsoft, EHR systems, and your practices. We do not control those services and are not responsible for them, including their availability or the accuracy of information they provide.

13.Fees

The Cara app is free to use today. If we introduce paid features, we will tell you before you are charged, and you will choose whether to pay for them. Practices pay for the Cara platform under their own agreements with Cara.

14.Intellectual property

Cara and its licensors own the Service, including its software, design, and brand. We give you a personal, non-transferable, revocable right to use the Cara app for your own care while you follow these Terms. If you send us feedback or ideas, we may use them without owing you anything.

15.Ending your use and deleting your account

You can stop using Cara and delete your account at any time in the app. When you delete your account, we delete or de-identify your Cara app data and disconnect your linked practices and connected accounts. Records a practice keeps in its own chart are governed by that practice, and some records may be kept where the law requires.

We may suspend or end your access if you break these Terms, if needed to protect you, other people, or the Service, or if required by law. Where reasonable, we will tell you first and give you a chance to download your data.

16.Disclaimers

To the extent the law allows, the Service is provided “as is” and “as available.” Cara makes no warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not promise that the Service will be uninterrupted, error free, or that information in it will be complete or correct.

17.Limitation of liability

To the extent the law allows, Cara will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost data, profits, or revenue, arising from or related to the Service or these Terms. Cara’s total liability for any claim related to the Service is limited to the greater of the amount you paid Cara for the Service in the 12 months before the claim, or 100 US dollars.

Some places do not allow these limits, so they may not apply to you. Nothing in these Terms limits liability that cannot be limited by law.

18.Indemnity

To the extent the law allows, you agree to defend and hold Cara harmless from claims, losses, and costs (including reasonable legal fees) that arise from your misuse of the Service or your violation of these Terms or of someone else’s rights.

19.Resolving disputes

If you have a concern, please contact us first at hello@caramedical.com. Most issues can be solved quickly this way, and we will try in good faith to resolve yours informally. If we cannot resolve a dispute informally, either of us may bring it in a court of competent jurisdiction.

20.Changes to these Terms

We may update these Terms from time to time. We will change the “Last updated” date above, and if a change is significant, we will tell you in the app or by email before it takes effect. If you keep using the Service after the change takes effect, you accept the updated Terms.

21.General

These Terms, together with our Privacy Policy, are the whole agreement between you and Cara about the Service. If any part of these Terms is found unenforceable, the rest stays in effect. If we do not enforce a part of these Terms, that is not a waiver. You may not transfer these Terms without our consent; we may transfer them as part of a merger, acquisition, or sale of assets.
